Pedestrian accidents are usually serious

February 3, 2012

When a motor vehicle comes into contact with a pedestrian, it’s almost certain that catastrophic personal injury will result, according to the Digital Journal.

In pedestrian accidents, pedestrians are unprotected from initial impact with the vehicle and secondary impact with the unforgiving ground.

These accidents often cause serious injuries, including brain and spinal cord injuries, life-long disabilities, and even death.

Pedestrians must obey traffic signals, use sidewalks and walkways, avoid placing themselves in danger, and be constantly alert to vehicle traffic. While motorists must obey traffic signals, cede the right of way in cross-walks, and be constantly alert to potential pedestrian traffic.

Pedestrian/vehicle accidents most often affect younger children. It’s important to instruct children in appropriate ways to safely walk on city streets.

Whether or not the pedestrian is responsible for the accident, the pedestrian may be able to seek compensation for property damage, injuries, and pain and suffering.

Injured Greyhound bus passenger awarded $7.2 million

December 21, 2011

A 24-year-old female survivor of a Greyhound bus crash in rural Texas in December 2007 was awarded a $7.2 million settlement by a Dallas jury this week, according to the Sacramental Bee.

The injured passenger alleged that the bus driver was using a cell phone while driving in icy conditions on Interstate 40 in Wheeler County, Texas.

The driver braked improperly as he approached a wreck on the highway and lost control of the bus, according to trial testimony. The bus rolled over, injuring the passenger’s head, neck, and back.

The evidence presented during the three week trial showed that the bus driver had received three speeding convictions shortly before Greyhound hired him and had used his cell phone 17 times in the three hours before the accident.

The jury found Greyhound and its drivers grossly negligent in the accident.

“The verdict will enable [the victim] to have lower-back surgery next month for injuries received in the crash. We hope it sends the message that companies like Greyhound will be held responsible for any injuries they cause. In this case, we alleged that Greyhound hired an unqualified driver, that he was improperly trained, and that he ultimately failed to control his speed, which caused the bus to flip over,” her lawyer said.

School bus crashed into building in north Houston

December 12, 2011

A charter school bus, owned by First Students, crashed into a building in north Houston on Thursday, December 8, according to KVUE news. It was transporting 37 children to two KIPP schools.

It crashed on West Hardy at Cross Timbers around 7:5 a.m. when the bus driver lost control of the bus.

Two eighth-grade boys pulled the unconscious bus driver out of the rear-door emergency exit. Then they helped the other students get off the bus.

A by-stander said, “There was a vehicle that cut her [the bus driver] off, and she tried to avoid it, hit the curb, and jumped into the building.”

Another witness who spoke to the bus driver immediately following the crash said the bus driver said an erratic driver caused her to veer off the road.

“She said it was a black vehicle swerving in and out of traffic. When he cut in front of her, he clipped her, and she tried to avoid him by moving away.”

All of the children were checked out by emergency personnel on the scene, and all of the injuries appeared minor. The bus driver was transported to Lyndon B. Johnson hospital for treatment.

Wildfires Spark Record Number of Texas Insurance Claims

September 14, 2011

Houston insurance companies say the wildfires that have ravaged the area have given way to a record number of fire claims in Texas.

Insurance Council of Texas Spokesman Mark Hanna told The Houston Chronicle that wildfire-related damages are estimated at $250 million, though the area most devastated by the fires—Balstrop—hasn’t yet been included in that figure.

So far, State Farm says it has received 800 fire claims—700 from Balstrop alone—and has already paid out $28 million. Meanwhile, USAA says its gotten 425 claims from the Balstrop area.

In 2009, statewide fire claims amounted to $115 million; this year’s losses are more than double that.

Experts speculate that the landslide of claims could add up to increased insurance rates.

“A single event in a single year doesn’t necessarily change rates, but it can contribute to a cumulative impact,” said Texas Department of Insurance Spokesman Jerry Hagins.

Of greater importance, says Insurance Information Institute President Robert Hartwig is whether nor not Texas will see an increase in wildfires in the coming years.

“If it’s going to be the case that Texas is going to be drier and hotter and wildfires will be more frequent, that will impact the cost,” said Hartwig. “It affects those areas that are prone to risk, just like somebody in El Paso isn’t paying for hurricane risk.”

How to Prevent Injury and Illness During Flooding

May 4, 2011

Last week a New York Times article pinpointed Dallas as the U.S. city most vulnerable to natural disaster; in fact, five of the eight most disaster-prone cities are located in Texas. Along with tornadoes and hurricanes, flooding is listed as one of the greatest risks for Texans-as Texas County residents experienced last month. However, there are some easy ways to safeguard yourself and your family from disease and personal injury during a flood.

The Illinois Department of Public Health recently released a number of solid recommendations for good health during a flood, predominately urging victims to avoid flood waters and sewer overflows which contain bacteria, fecal matter, and disease-causing organisms.

Here are some more guidelines for taking precaution during a flood:

— Use only bottled or boiled water for drinking, cooking, and brushing your teeth until you’re sure that your water supply is safe. Don’t ingest anything that’s come in contact with sewer water.

— Keep cuts and sores covered and away from sewer water. If you do have a cut or sore that’s been exposed to sewer water, get a Tetanus shot if it’s been more than five years since you last received one.

— Don’t permit children to play in areas with contaminated water.

— Keep contaminated objects away from your eyes, mouth, and nose.

— Wash your hands after using the bathroom and before eating, and wash your hands immediately if you’ve come into contact with sewer water.
